PRENUPTIAL AGREEMENT
A Prenuptial Agreement is a written contract signed prior to a marriage that identifies the assets and debts of the parties and sets forth what happens to those assets and debts if the parties later divorce. You do not need to be extremely wealthy to consider a Prenuptial Agreement. Many average income earners with few assets acquire a Prenuptial Agreement to help them plan with certainty for the future. Smart people create agreements to describe future property rights of the parties or their children should a divorce occur.
ENFORCEABILITY OF PRENUPTIAL AGREEMENTS
Prenuptial Agreements are enforceable in Pennsylvania so long as the document is signed by both parties and provides full and fair disclosure of property and debts of the parties. Failure to disclose property or debt can serve as a basis to set aside a Prenuptial Agreement aside. It also strongly recommended that each party have independent counsel review a Prenuptial Agreement and provide sufficient time for the parties to consider the document and negotiate changes before it is signed.
We help clients create enforceable Prenuptial Agreements. We can provide suggestions for your individual situation and include language in the agreement that is tailored to your unique needs. For example, we can include clauses that protect real estate or inheritance owned prior to the marriage, protections against liability for the other spouse’s debts, division of property acquired during the marriage, alimony and spousal support provisions and retirement benefit clauses.
We understand that couples who plan to marry are building a relationship and wish to trust each other. She can help you understand how creating a Prenuptial Agreement can avoid problems down the road and help build trust. Prenuptial Agreements remove any doubt as to what will happen should the parties divorce. They provide certainty to couples who do not want to roll the dice with the family court down the road.
