HIGH CONFLICT CUSTODY CASES

High conflict custody cases involve parents who are not able to resolve their child custody disputes without litigation. In these cases, there are major communication problems and significant anger involved. The parents do not trust each other and the children are often innocent casualties of these terrible battles.

High conflict custody cases cannot be mediated or resolved by agreement. For these cases a judge must hear the evidence at a custody trial and make a decision.

Parental alienation is often observed in high conflict custody cases. In these cases, a child will align with a parent who rejects the other parent by making disparaging accusations (often times untrue) in the presence of the children thus causing the child to be alienated from the other parent. The child feels that the parent wants them to hate the other parent and the child will do almost anything to please the parent they are aligned with. These cases are extremely challenging to handle because of the emotional devastation that is caused by alienating a child from his or her parent.

Parents involved in high conflict custody cases require skilled knowledgeable legal representation. The parents and children may also benefit from working with trained mental health providers. Sometimes the children have their own counselor to help them deal with the turmoil of a high conflict custody case.
